Terms of sale and use

1. Who we are

FSGRW ("FS Global Real Weather") is operated by Bernd Podhradsky, Marienhofweg 662, 2534 Alland, Austria ("we"; see the imprint). These terms apply to buying and using FSGRW products: the plugins and add-ons for flight simulators and the weather data they download.

2. Our reseller: Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's terms for buyers apply to the purchase:paddle.com/legal/checkout-buyer-terms. The invoice comes from Paddle.

3. Products and prices

Each FSGRW product is for one flight simulator. "All simulators" includes every FSGRW product offered at the time of purchase. Prices are shown on the product pages and include VAT.

Perpetual license: one payment, no expiry date; the product can be used for as long as we offer it and operate the FSGRW weather service, including its updates.
Upgrade to all simulators: what you paid for perpetual licenses counts towards "All simulators" (perpetual license); the upgrade costs at least the perpetual license price of the cheapest product you do not own yet.
Subscription (yearly or monthly): the product can be used for the paid period. The subscription renews automatically until it is cancelled; it can be cancelled at any time in your account (Subscriptions and invoices) and then ends at the end of the paid period.

4. Your account and computers

A purchase belongs to your FSGRW account. Each product can be registered on one computer at a time. Registered computers can be removed in your account or in the plugin; you can remove a computer twice within 30 days; each removal is available again 30 days after it was used. Accounts and registrations are personal and may not be shared or resold.

5. Weather data and service

FSGRW products download weather snapshots from our servers, which need an internet connection. The weather is made from public observations and weather models for use in flight simulators only; it is not suitable for real-world flight planning or navigation. We aim for a continuous service but cannot guarantee that every snapshot is available or correct at all times.

7. Liability

We are liable without limitation for damage caused intentionally or by gross negligence and for injury to life, body or health. For slight negligence we are liable only for the breach of essential obligations of the contract, and only for the damage typical and foreseeable for this kind of contract, at most up to the price paid. Liability under mandatory law (such as product liability) remains unaffected. The weather data are made for flight simulation only; we are not liable for their use for any other purpose.

8. Changes and applicable law

We may change these terms for future purchases; the terms at the time of purchase apply to it. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country where you live remain applicable, and you can also bring claims before the courts there. For businesses, the place of jurisdiction is the court competent for 2534 Alland, Austria.
